Your advert
By placing your advert, you are requesting that the details of your
vehicle appear on all
corresponding websites within the DesperateSeller.co.uk network. No contract is made between us until we have verified
and accepted your advert copy. We will contact you (by return
e-mail address, if supplied) if we are not able to accept your advert copy.
For formatting reasons, you must provide your advert copy by completing
our online advert form. The copyright for your advert
shall be owned by DesperateSeller.co.uk Ltd and you hereby assign all such copyright to us.
Any advert copy received after
4.00pm on a Friday will not be verified and accepted before the following
Monday (excluding Bank Holidays).
Your advert copy must be legal, decent, honest and truthful and comply
with the British Code of Advertising Standards Authority. We may amend the
advert to ensure compliance with such requirements.
Each advert must be for a maximum of one vehicle.
We are not able to verify the truthfulness of any statements made by you
in your advert copy. Accordingly, you shall be responsible for any losses,
expenses or other costs incurred by us which are caused by an untrue
statement deliberately made or provided by you. We do not intend and
will not be required to edit or review for accuracy or appropriateness of
any advert content.
On placing your
advert you consent to all corresponding websites' individual terms and
conditions. If any breach of the corresponding websites terms and
conditions have been made they reserve the right to remove your advert.
After 6 months we reserve the right to delete
your advert from our database due to inactivity or lack of correspondence. This will not be
carried out without prior notification.
Your personal data
All personal information
collected and used from the DesperateSeller.co.uk website will be processed
in accordance with the Data Protection Act.
Your credit card data
Our website contains hypertext links to the commerce provider/ financial
acquirer. We do not control and are not responsible for any services
provided by the commerce provider/ financial acquirer. We do not accept
any liability for any loss or damage you may suffer as a result of using
the commerce provider/ financial acquirer.
Changes, cancellations and interruptions
Once accepted you may amend your advert at any time.
Once payment is received we are unable to cancel your advert as the
fulfillment of the offered service begins automatically.
Once the advert is no longer required it is your responsibility to
delete your advert using the 'My Account' facility on the website.
It is technically impossible to provide a website free from interruptions
and (except to the extent that interruptions are caused by our negligence)
we do not guarantee that your advert will be provided continuously or free
of faults. This term is extended to all websites that receive your
advert.
English law
These terms and conditions and the contract of which they form a part
shall be governed by English law.
Our terms and conditions do
not affect your statutory rights as a consumer.
Privacy Policy:
We
are committed to protecting your privacy. We will only use the information
that we collect about you lawfully (in accordance with the Data Protection
Act).
We collect
information about you for 2 reasons: firstly, to process your order and
second, to provide you with the best possible service.
We will not
e-mail you in the future unless you have given us your consent.
We will
never collect sensitive information about you without your explicit
consent.
The
information we hold will be accurate and up to date. You can check the
information that we hold about you by emailing us. If you find any
inaccuracies we will delete or correct it promptly.The
personal information which we hold will be held securely in accordance
with our internal security policy.
We may use
technology to track the patterns of behaviour of visitors to our website.
This can include using a "cookie" which would be stored on your
browser. You can usually modify your browser to prevent this happening.
The information collected in this way can be used to identify you unless
